By accessing the Website, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to all of the terms, you are expressly prohibited from using the Website and must stop using it immediately.

We reserve the right, at our sole discretion, to modify or update these Terms and Conditions at any time for any reason. Changes will be indicated by updating the “Last updated” date, and you waive any right to receive specific notice of each modification. It is your responsibility to review these Terms and Conditions periodically to stay informed of updates. Your continued use of the Website after any revisions are posted constitutes your acceptance of the revised Terms.

The Website's services are not intended for use in any jurisdiction or country where such use would violate local laws or regulations. If you choose to access the Website from outside the permitted regions, you do so on your own initiative and are solely responsible for ensuring compliance with applicable local laws.




1. eSIM service

The Provider sells prepaid eSIM with data service plans using eSIM technology (the “Service”). The Provider may be reselling the Service through a Partner or an Agent.




2. Terms of service

Registration

Customers may register for the Service through our Website or via authorised partners or agents.

To register, customers must provide their first and last name, along with a verifiable email address. Customers may also voluntarily upload a profile photo and share their travel preferences.

Registration requires acceptance of the General Terms and Conditions and the Privacy Policy.

Purchase and Activation

The Provider may restrict the availability of certain plans in specific countries. Customers can browse, select, and purchase plans through the Website or via authorised partners and agents.

By purchasing the Service, customers confirm that they own an unlocked, eSIM-compatible device, which is necessary to use the Service.

Upon purchase, customers must download the eSIM to their device to configure the data plan as per the order. The eSIM will remain on the device even after the plan's credit is used or the plan expires. Customers can remove the eSIM via their device settings at any time, though it is recommended to keep the eSIM installed until the plan is fully consumed or expires.

To begin using the Service, customers must first download the eSIM and activate the associated data plan. A stable internet connection may be required for these steps.

Duration and Termination

The Service begins upon the successful download of the eSIM and activation of the associated data plan.

The Service duration is determined by the terms of the purchased plan and will end upon either full consumption of the data or plan expiration, whichever occurs first.

The Provider may suspend or terminate the Customer's use of the Service without notice in cases of breach of customer obligations. The Provider reserves the right to close any Customer's account if they violate these Terms and Conditions or any applicable law or regulation.

Engagement

The Service is provided on an "as is" and "as available" basis. While the Provider will take reasonable steps to ensure service availability, it relies on technology and network infrastructure provided by partners and cannot guarantee uninterrupted network coverage, quality, or availability.

The Provider may collaborate with third-party entities to deliver the Service and is not required to inform customers about such partnerships. Customers agree to comply with the terms and conditions of these partners as well.

Service availability depends on our partners' ability to maintain network capacity and connection availability, which cannot be guaranteed.

Customer Obligations

Customers agree to:

Use the Service in compliance with these Terms and Conditions and assume responsibility for all usage.

Provide true, accurate, and complete registration information and keep it up to date.

Keep their account credentials, including passwords, confidential and accept responsibility for all account activity. The Provider reserves the right to remove or change usernames deemed objectionable at its sole discretion.

Use the Service in accordance with all applicable laws of their home country, country of residence, and the country in which they are present.

Use the Service solely for personal, non-commercial purposes.

Refrain from using the Service for any abusive, illegal, or fraudulent activity or in any manner that could impair or damage the network.

The Provider reserves the right to suspend the Service in case of non-compliance with the above obligations. Customers remain liable for all charges incurred during any suspension. Any attempt to damage or undermine the legitimate operation of the Service may result in civil and criminal penalties. The Provider reserves the right to pursue legal remedies and damages (including attorney fees) to the fullest extent permitted by law, including criminal prosecution.




3. Payment Terms

Customers can register and purchase eSIMs directly through the Website. Payments may be processed via an authorised agent of the Provider.

All eSIMs are prepaid, and prices include any applicable indirect taxes unless otherwise stated. Indirect taxes will be calculated based on the zip code provided in the billing information associated with the credit card payment.

"Indirect Taxes" refer to sales tax, GST, value-added tax (VAT), and any similar taxes or levies imposed by government authorities at the time of purchasing the plans.




4. Returns and Refunds Policy

Customers will be charged at the time of purchasing an eSIM.

Refunds or changes may be requested before the eSIM is installed and activated, or if a technical issue originating from the Provider is identified after activation.

5. Governing Law and Legal Compliance

This Agreement, along with any non-contractual obligations arising from or related to it, shall be governed by and interpreted in accordance with the laws of New Zealand. Any disputes arising under or in connection with this Agreement will be subject to the exclusive jurisdiction of the courts of New Zealand.

Additionally, your use of the Services may be subject to mandatory rules, regulations, and laws of other jurisdictions.

To comply with legal and regulatory requirements, we may need to collect certain personal information from you. If we request such information and specify that it is for legal or regulatory purposes, you agree to provide accurate and truthful information.
